Mediation

The Harding Law Office’s primary approach to simplifying the divorce process is mediation. In mediation, the parties seek to negotiate the issues in their divorce with the assistance of one or more neutrals. The mediator helps keep the parties focused on the issues, despite the emotional tension that is usually present. The mediator can also provide information about relevant statutes and court decisions that help the couple understand what may happen, should their divorce be decided in court. Direct negotiation allows the parties to craft an agreement that is tailored to their needs, rather than to the opinion of a judge. |
The mediators of the Harding Law Office are trained in helping couples overcome the hurdles that sidetrack divorce negotiations, much as do mediators in labor or international negotiations. Most of our mediations take between two and five hours, even for a divorce involving children and substantial assets. The divorcing couple decides, with the mediator’s assistance, how many mediation sessions are needed and how long each will last. The result of a successful mediation is an agreement for an enforceable court order which will govern your divorce after the decree is finalized. |

Co-Mediation In co-mediation, or team mediation, the divorcing couple meets with two mediators, usually a man and a woman, one an attorney and the other a counselor. Co-mediation is effective where the parties seek a balance of genders or where the emotional conflict in the divorce is such that the involvement of a counselor would be useful.
